Privacy policy

This privacy policy sets out the rules for the processing and protection of data of website users at: lumax.pl (“Website”). The website you use is provided by BestService sp.z o.o. based in Warsaw (“BestService”).

In order to explain in detail the rules we apply when collecting and processing data made available to BestService, this Privacy Policy has been created.

Personal data and other non-personal data collected through the Website are stored on a secure server. Access to the data is granted to authorized personnel, trained in the field of personal data protection and IT system security, as well as obliged to maintain strict confidentiality.

This Privacy Policy contains provisions regarding the personal data of persons browsing the Website and persons using the contact box (“Users”).

The information contained on the Website is checked for correctness. The Administrator reserves the right to make changes to the content of the Website and this policy.

Collection of personal data through the Website

The personal data of the Website Users is collected and processed depending on the manner in which the User uses the Website. The User’s personal data may be collected and processed in connection with the provision of services offered by the Website, the Website’s operation, use of the contact form or the calculator available on the Website.

Providing personal data is voluntary, however, failure to provide the data that is necessary to use a given Website service may prevent the User from using this service.

Purposes of personal data processing

Website Users’ data are processed in order to ensure the proper functioning of the Website, i.e. displaying the content of the Website, in order to maintain a session on this Website, and to ensure security. The Website Users’ data collected as part of the contact form or the calculator provided on the Website are processed for the purposes of providing an answer sent by the User or, possibly, submitting an offer, if the User asked for it.

In the event that the User, using the functionality of the Website, expresses the appropriate consent, the data is processed for BestService marketing purposes, for the purpose of providing commercial information (Article 10 (2) of the Act of July 18, 2002 on the provision of electronic services, Journal of Laws No. U. of 2019, item 123 and Article 172 of the Telecommunications Act of July 16, 2004, Journal of Laws of 2018, item 1954).

Legal basis for the processing of personal data

The basis for processing the data of Users using the Website’s functionality is the need to perform a contract (on the provision of electronic services) to which the data subject is a party, or to take action at the request of the data subject, before concluding the contract (legal basis: Article 6 sec. 1 point b) of the General Data Protection Regulation). The above services (provided under the contract for the provision of electronic services) are free of charge, their provision begins when the User visits the Website and depending on which functionalities of the Website are used, they include: viewing the content available on the Website (including all of it subpages), sending an inquiry via the contact box, using the calculator available on the Website.

The basis for data processing for analytical and statistical purposes collected with the use of Google Analytics tools is the legitimate interest pursued by the administrator, consisting in analyzing the traffic and behavior of Website Users and creating statistical studies on this basis to optimize the usability of the Website (pursuant to art. 1 letter f) of the General Data Protection Regulation).

The basis for data processing for advertising purposes collected with the use of Google Analytics tools is the voluntary consent expressed by the User (pursuant to Article 6 (1) (a) of the General Data Protection Regulation).

The basis for the processing of data provided to BestService by the User using the contact form or the calculator is the legitimate interest of the administrator, consisting in answering the submitted inquiry (Article 6 (1) (f) of the General Data Protection Regulation).

In addition, the basis for data processing for marketing purposes, regarding the transmission of the administrator’s commercial information, is the voluntary, express consent of the User (expressed using the Website’s functionality) to:

1.receiving commercial information by electronic means regarding BestService’s own products and services, pursuant to Art. 10 sec. 2 of the Act of July 18, 2002 on the provision of electronic services,

2.receiving personalized BestService marketing information by e-mail using telecommunications end devices for purposes related to direct marketing, in accordance with art. 172 of the Act of July 16, 2004 Telecommunications Law,

3. making contact by phone in connection with the submitted inquiry or request to send an offer for the purpose related to direct marketing, in accordance with art. 172 of the Act of July 16, 2004, Telecommunications Law.

Information on the recipients of personal data and the transfer of data to a third country

The personal data of the Website Users may be disclosed to other entities only for purposes related to the provision of the Website content and functionality, including bodies authorized by law.

Data of Users who have not objected to the processing of data for analytical and statistical purposes, as well as Users who have consented to the processing of data for advertising purposes, collected using Google Analytics tools upon entering the Website, will be entrusted to companies from the Google group (Google LLC 1600 Amphitheater Parkway Mountain View, CA 94043 USA) for the use of Google Analytics analytical tools on the Website. Users’ data, in connection with the use of the Google Maps plug-in by the Website, are transferred to Google LLC 1600 Amphitheater Parkway Mountain View, CA 94043 USA. When data is transferred to the United States, the provisions of the EU-US Privacy Shield are respected. The transfer of data to other countries outside the European Economic Area takes place on the basis of model contractual clauses. The transfer of data outside the European Economic Area does not affect the possibility of exercising the rights of the data subject, including the right to access and copy the data (in such cases, please contact the Administrator directly).

The Administrator entrusts the processing of Users’ data to subcontractors providing hosting (hosting the data of persons using the Website) and ICT services. In addition, the Administrator entrusts the processing of data of Users who, to receive commercial information from the Administrator, as well as to use telecommunications end devices for direct marketing purposes, to entities providing hosting (e-mail hosting) and ICT services (operator of the telecommunications network used by the Administrator ), data storage (cloud) (Article 10 (2) of the Act of July 18, 2002 on the provision of electronic services, and Article 172 of the Act of July 16, 2004, Telecommunications Law).

The period for which personal data will be stored

The User’s data collected in connection with browsing the Website by the User are processed in accordance with the table of using cookies (below), but no longer than until the User clears the content of cookies in the browser whose services the User uses. Users’ data is collected and analyzed with the use of cookies, including Google Analytics tools, are processed until the settings are changed, consisting in resignation from enabling the collection of data using cookies, including Google Analytics tools.

Users’ data processed in connection with submitting an inquiry via the contact box and prior to submitting the inquiry, using the calculator, as well as sending commercial messages, are processed for a time which depends on the purpose for which the Administrator processes the data:

1. The data of Users who make contact via the contact box in the “Contact” tab on the Website will be processed for a period of one month from the date of sending the last message, in order to maintain the continuity of correspondence;

2. Data of Users who make contact via the contact box in the “Contact” tab, in order to be bound by the contract, as part of the services provided by BestService, will be processed later for the performance of the contract, for the time necessary for its performance and for the need to defend claims after its execution.

3. The data of users who have consented to the processing of data for the marketing purposes of the administrator, including for the purposes of receiving commercial information, are processed for the duration of such consent, i.e. until it is withdrawn.

Rights of data subjects

Please be advised that each data subject has the right to access their personal data and may request their correction, rectification, deletion, limitation of their processing, and has the right to object to their processing (when the processing is based on the legitimate interest of the administrator). pursuant to art.6 par.1 lit.f) GDPR), the right to transfer your data on the basis of a contract in accordance with art. 6 sec. 1 lit. b) GDPR. In the event that the processing of personal data is based on consent, pursuant to art. 6 sec. 1 lit. a) GDPR, the User has the right to withdraw consent for the processing of personal data, with the proviso that the withdrawal of consent will not affect the processing that took place on the basis of consent before its withdrawal. In addition, if the data is processed on the basis of consent, the User has the right to request the transfer of personal data.

In connection with the processing of personal data, the persons whose data are processed have a complaint to the supervisory body (the President of the Personal Data Protection Office).

The User has the right to withdraw the consent expressed on the basis of the Act of 18 July 2002 on the provision of electronic services and the Act of 16 July 2004 Telecommunications Law, at any time.

Information whether providing data is a statutory / contractual requirement and the consequences of not providing data

Providing personal data is voluntary, but necessary to use the Website, receive commercial information, submit a complaint about the operation of the Website, or make inquiries. Wherever the Administrator asks for consent to the processing of personal data, failure to provide it will result in the Administrator not collecting such data.

Browsing the Site and subpages

Browsing the Website involves the need to disclose to us the IP address and personal data collected via cookies and other technologies placed by the Website on the device used by the User. On their basis, it is possible, inter alia, specification of the country and telecommunications operator through which a given User connects to the Website. The data obtained automatically by the Website are: User’s IP address, information about the computer and connection, browser type and version, types and versions of browser plug-ins, operating system.

In addition – but only if you do not change the browser settings – the website collects additional data on the pages visited, such as: number of visits, country, browser, visit time, etc., which are analyzed using Google Analytics tools that help to understand how Users use the Site. This information will only be used for aggregated, anonymous statistical analysis, which will allow us to improve the products and customer service of this Website.

If the User agrees, we also use the collected data for advertising purposes via Google Analytics tools. Data processed for marketing purposes will be used to analyze how you use the Website and to control advertising activities carried out by BestService by displaying BestService advertisements to the User when using other websites.

Security of collected data

Personal data and other non-personal data collected through the Website are stored on a secure server and only authorized personnel, trained in the protection of personal data and IT system security, and obliged to maintain strict confidentiality, have access to the data. In order to obtain information on the services provided or technical support for Users, the User may send an inquiry directly to the technical support service by completing the form on the Website. Users’ inquiries, including complaints about the operation of the Website, will be considered by the Administrator on an ongoing basis. The response to the inquiry (complaint) will be sent via e-mail to the address provided in the inquiry (complaint).

Some of the elements of the Website may use cookies, i.e. cookies. These are small files saved in the User’s browser. They make it possible to store additional data related only to the User, Such files make it possible to identify the User, allow for the adaptation of the website to the User, and also speed up some operations.
